   (Kuala Lumpur, on the 13th) - Securities Commission (SC) and the National Bank (BNM) while repeatedly reminded the public not to be approved investment in the absence of the high investment returns, but such investment company continues active.    It is always neccessary to “impress” before money can be taken from you! That, obviously worked in YiNg’s case. This is called PACKAGING. This is part and parcel of “marketing” - the world of make believe. (Will you pay $600 for a handbag if it was sold in the back alleys of Geylang?)

   I am a 55 year old businessman with extensive business experience having sat on boards of some prominent companies and can therefore claim some degree of knowledge about such businesses …. more than an average man in the street.

   When I was approached, I already felt uncomfortable. In order to give the whole scheme of things some semblence of credibility, it was emphasised to me that the business is “owned” by a “large developer” from Malaysia. (Pictures of some little known mega project in Malacca were shown.) To accomodate a friend, I reluctantly went to their Toa Payoh office. (Shared by 3 business entities from selling underwear to whatever) Impressed? To those of you who are, you do not know what impressive is yet. Not bad though. A young man (younger than my son) sat me down to introduce the company. Same story…big time owners…therefore reliable. His first and fatal mistake was to flash me the company registration of the Singapore entity. I demolished all his selling within 2 mins flat. The owners of the company are 2 individuals who have no relation with the so called developer (legally). The main players’ names are non existent in the Singapore company! (Why do the main players’, whose names are bandied about at every turn, not include their own names in this legal entity?) For the uninformed, it will do you good to note the residential addresses of the 2 shareholders to determine if that is not an anti climax to the “big developer” picture. Technically, if and when the company collapses, the collectors of your hard-earned money (whoever, the ultimate beneficiaries of this scheme be)are not legally liable! Without the glam of the so called who is who, will you give your money away?

   There are just too many loopholes for me to buy the idea. To me, this is a very amatuerish effort to set up a MLM scheme. Whether it is a scam is for the individual to decide. Suffice it is for me to remind readers of organisations such as the one who sold gold krugerrands (one ounce South African gold coins)not too long ago at inflated prices. Go ahead and do some research.

    Sunshine Empire, if your business is transparent enough, Can you provide your income estatement? How is it possible that the company can afford to use the people’s money on a certain investment like empire state bldg. and the like if the pay outs is more than 100% interest against the bank? If your pay out in one year is more that 100% in 15 months, why cant the sunshine empire borrow money in the bank that you can only pay at 8% per annum? isnt that unwise to pay more than 100% interest in 18 mos. while you can only pay 8% per annum instead? the bank should be the lesser interest compared to getting cash to people where sunshine empire pays a lot, more than 100% in 18 mos?! if the company is earning and transparent please show to the investor that sunshine is really earning. Please help me not to be confused!

    if sunshine is clean, CAD in singapore will clear it. no point to argue too much. let the CAd do the job.

    for your info, one of their subsidiary - EMCOM - has now closed suddenly after CAD checked. EMCOM is suppose to take care of the tai chung wireless city project. right now under investigation, the whole website went down. what i know internally is that the mgt team is on the run. most of them are out of SG and else where “enjoying”. if things are as true as it is,it is not necessary to shut down EMCOM.

    maybe SE will use EMCOM and the investigation by CAD as a reason for project failure. so everyone lose the invested amount. then the so call president will say that he lost a fortune and blah blah blah. 2 weeks later, another new project will come up and offering better returns. maybe buy over a country or a property and developing it.

    MULTI-LEVEL marketing (MLM) firm Sunshine Empire has welcomed a Commercial Affairs Department (CAD) investigation into its activities and says it is confident it will be found ‘clear of suspicion’.

    Sunshine spokesman Kegan Lee said in a statement: ‘We are indeed glad to hear that the CAD has begun investigation into this matter.

    ‘We have, in fact, written to the CAD to ask them to investigate this very matter, so that it may be put to rest and we can set the record straight.’

    Sunshine’s president (Asia Pacific), Mr Jackie Hoo, wrote to the CAD on Nov 6, asking it to clarify if the controversial firm was under investigation.

    He also said company executives ‘would be most happy’ to meet CAD officers to explain its business activities ‘in order to clear any misunderstandings or misconceptions’.

    The CAD announced on Tuesday that it had started an investigation but did not specify when it began.

    The Straits Times cited sources on Oct 24 who said Sunshine was under CAD investigation.

    The firm has been on the Monetary Authority of Singapore’s investor alert list since September.

    It has attracted attention as its selling activities appear more like those of a pure investment scheme, for which it is not licensed.

    The firm invites people to become ‘merchants’ of online goods, ranging from health supplements to electronics goods.

    But concerns centre on the fact that participants can potentially pocket big ‘rebates’ without ever buying or selling these goods.

    On Tuesday, the CAD advised people who have placed money with Sunshine to wait for further updates from the department.

    It also said that it may ask those who have placed money in Sunshine to help with the investigation.

    The Consumers Association of Singapore has advised Sunshine members to pull out their cash if they are worried about the CAD probe.

    Mr Lee told The Straits Times that there have been no requests for refunds from participants.

    Some Sunshine participants said they will adopt a wait-and- see attitude before deciding what to do.

    MLM firms, which are legal in Singapore, typically invite people to pay cash for the right to market goods to other people.

    All who invested in this company and its schemes beware! I overheard from some of the so-called leaders whispering among themselves that Singapore SE going to close and abandon all the people who invested in singapore soon because the funds are drying up due to the ongoing CAD investigation!

    They are spreading among themselves that just close Singapore office and shift to indonesia, malaysia, or china or hong kong and continue the scheme there. Then blame it on economic recession and Singapore government. A lot of the leaders now in hong kong and macau, spending money like mad on entertainment like casino and KTV and call girls!

    All the fools who put money in Sunshine Empire, do you know what you really invest in? You invested into their leaders decadent lifestyles opening bottles in KTV, frittering away your money in casino and buying luxury cars!

    Please please, all the people who read this post, please call CAD and report them, especially if you have money with them, because they are running soon and not coming back! please get your money out before it is too late! Please inform all the people around you especially if you have friends and relatives who put money with them.

    Ever wonder why SE suddenly got the money to reward all the first batch investors in EMCOM?

    Why suddenly James Phang gone so crazy to organize a series of “conventions” or “da hui” in the last quater of 2007?

    Why suddenly James Phang came out with some crazy ideas like bio-diesel, financial loans, insurance, casino, etc… while everything was going so smooth?

    Why the EGA can close EMCOM so EASILY if they are really on such money making projects… 4G, wireless cities?

    (Emcom International in HK - formerly China Photar is just an loosing money company that acquired by James Phang. It has no relation with EMCOM in s’pore or the wireless cities projects.)

    Is it because when Taiyee left EGA, they pay out a big sum, and JP used part of the money to pay the first batch of investors?

    Is it because they afraid when ppl knows that there’s no more wireless projects, the company sales will drop and therefore the none stop conventions in a roll?

    Is it that why JP suddenly came out with all those crazy ideas? Cos no more wireless cities, therefore no more CLP… hoping that these crazy ideas can be of substitutes for the wireless project?

    1. in the eye of laws, talks or ‘black and white’, which is important?
    2. moving to an online company from base in a country, is it safe?
    3. who can you look for, in the case of company “gone in the air”?
    4. what is the history about the past of James? since NOP… (NOP - selling places for ‘dead’, magic kingdom, ‘china dream’, sunshine, and now - EM-MAX.COM. What next?
    5. currently, CAD (singapore) follow by indonesia, korea, etc… now with bank negara malaysia (these illegal activities are offences under subsection 25(1) Bank and financial institutions act 1989 (BAFIA), subsection 4(1) of Anti-Money Laundering and Anti-Terrorism Financing act 2001 (AMLA) respectively.) What will be next?
    6. for the form that they asking (maybe forcing) the members to sign at current. is it a form of transfer or resignation/termination on sunshine? the form for em-max, is it a member or merchantship application?
    7. is there any mention of refunds or amount mention in the form? isn’t it so rush to get ppl signing at the moment (since the case is till ongoing)?
    8. is this “once the company accepts the resignation/self-terminations of merchantship, …. to the said merchantship shall be forfeited.” stated in the form for sunshine?
    9. is this “… reserves the right to accept or reject any application form for any reason at its discretion…..” stated in form for emmax?
    10. do you think gov of each country are really free to do all this? isn’t them protecting their ppl from been hurt badly?
    11. Ever mention in st.time (singapore), members are advise to wait and dun do anything till the outcome release by CAD, isn’t it?
    12. Are we joining their project of tech, or others?
    13. Isn’t their role to inform us about any news or whatever at point of time? Have they done it?

    In the eye of laws, you can have someone telling you stories over days or years, and when you sign a paper of your agreement within min, law will only take in the paper. This is the real world.

    One of the projects in ‘max’, is it about gambling? think that is the reason why malaysia given such laws on 4 Apr 08.

    Understand that joining Em-Max means terminating your Sunshine Empire distributorship and joining a new MLM.

    If you can terminate your distributorship with Sunshine Empire, it does mean that you can also ask for a refund under a Buy Back Guarantee. (Singapore MLM and Pyramid Selling [Prohibition] Act allows and indeed demands it.)

    If you are under Em-Max, it will mean that you are now a Distributor of a Hong Kong company under Hong Kong laws, which means, even if the CAD asks SE to refund all its distributors, you will NOT get anything. You are technically no longer under the protection of the Singapore Government.

    Please do NOT B*LLSH*T and accuse the Singapore Government of trying to stop people from getting their money - it is SUNSHINE EMPIRE that is NOT paying you what you should be getting, and blaming it on the CAD and the UOB Bank. The Government is not trying to stop people from making money, they are trying to stop a MONEYGAME.

    Like what some of the people here said - where is EMCOM? Where is Emcall? Where are all the different projects? Why is SE not a member of the Direct Selling Association of Singapore (DSAS)?

    IF SE had planned to be legitimate and done their homework properly, including acquiring the relevant Direct Selling license (Malaysia) and understanding the Anti-Money Laundering Act, CAD would NOT need to investigate them. (Not even prosecute them yet)

    Why do you NOT see CAD “freezing” (ie. prosecuting) Amway, Nu Skin, USANA, Tupperware or some other REAL direct selling companies?

    Let me repeat again - CAD has NOT prosecuted SE, and SE has used this opportunity to retain all the “investments” that you SE guys have put in.

    In a nutshell, go to the CAD with your police report about SE conning your money, and when the Government forces SE to restitute the victims, YOU can receive your share. If not, you are an accomplice and liable to penalty under the SG MLM Act as well.

    Im a VICTIM of the Sunshine Empire’s (Malaysia)SCAM. I join this scheme since Sept 2007 as a gold member. I invested 27K and onli recovered around 10K by now.

    Now i’m aware and i TOTALLy believe this is a SCAM!!
    any members here who is kind enough to share, how can i get back the balance of my money?
    My so called up line ask me to sign a termination form and join a HK company (which the terms are totally not protect the invester). so, i refuse to sign on it, and i’m thinking to
    lodge a police report.

    Is there any other way i can do for this?

    there are few ways to go about it.
    1. report to police
    2. send letters to ask for ‘full refunds’ and state that the right of se will not end till u receive full refunds
    3. in letters, ask for reply in black and white only. and give them dateline to reply. will be best to send in ar mail from post office.
    4. can go to lawyer (after the steps mention will be better as u have proof.)

    so far, i would think of this… but there are till ways, i guess. maybe can get help from gov. area.

    Look I don’t like to make a debate or anything, i’m just dissapoint with all the comment about SE and CAD. From my point of view everything is good until CAD step in for dunno how long (forever probably until SE declare bankruptcy because can’t pay all the debt because of frozen money). It is like they just want to prolong and do nothing. I got bad experience with police because they always can do what they want and they have the right to do so with just an excuse of expect this and that and 1001 excuse until they get what they want. For me, i think that people are not stupid enough and always need someone to protect them. If you want to put money, you already know the risk of losing the money

    For me, i checked the risk and see a posibility for the company to grow and expand for the next 1 to 2 years before they really can stabilize or bankrupt.

    If you’re a business owner you’ll understand what i mean. If you cut the business in the middle surely you will make the business colapse, especially if you freeze the money, without cash flow basically you’re a sitting duck.

    But because CAD step in in the middle of the process, the business colapse. Funny thing about CAD if SE is really a scam without proper business they will directly know right ? Why you need 6 months just to find a prove that this company is a scam and still don’t know when all this thing will finish. And until now you don’t even have a progress and tell the people what you found inside SE. Keep quiet is as bad as doing nothing.

    I don’t want to say anything bad about CAD or praise SE. I’m just a person who put money inside SE. True it is because of greed. But i don’t like all the bull**** that say that the merchandise stupid or anything. Everybody has their own judgemnet and onething about this case is external factor which you can’t judge before all these things happen which is CAD
